论被害人有意过错在暴力犯罪中的作用

On the Role of the Victim's Intentional Fault in Violent Crimes

犯罪人与被害人是导致犯罪发生的两个方面,然而大多数人们和学者往往更多的关注犯罪人的过错对犯罪发生的作用,而忽视了被害人在犯罪发生中的作用。在司法实践中,存在着很多被害人过错诱发犯罪发生、促进犯罪实施、促成犯罪后果等作用。研究被害人过错中的有意过错,对减少和预防犯罪的发生,降低犯罪的危害程度有着重要意义。本文对暴力犯罪中被害人有意过错在犯罪中的作用进行分析,旨在通过运用这一结论提出建议,在一定程度上预防打击暴力犯罪。

the offenders and victims are the two sides leading to the happening of a crime.however, most of the people and scholars often pay more attention to the fault of the offenders when the crime occurred, and ignored the role of the victim played in the crime. In judicial practice, it is not uncommon to see that the victims＂ fault make crime happen, promote committing a crime , and contribute to crime consequences. It is meaningful to study on the victim＇s intentional fault for reducing and preventing the occurrence of crime, and reducing crime harm degree. This paper analyse the role of victims in a crime to prevent and combat violent crime to a certain extent.
