摘要
讨论了与城市建设关系较为密切的建筑作品的权利归属、修改权以及复制权等问题。认为为避免纠纷,设计方与建筑所有人应在合同中明确约定建筑作品著作权的归属及修改权的行使等内容;对于建筑作品的抄袭问题,建筑作品复制的概念应限于从立体到立体的再现过程,对复制侵权的认定宜采用分解分析法,并且侵权的法律责任形式应主要采用改建和经济赔偿的形式。
This article discusses some copyright issues of architectural works related to urban construction. To avoid disputes, the architect designers and the owner of a building may agree on its authorship and right of alteration in a written instrument. As to plagiarism of architectural works, the reproduction of it only means reproducing from three - dimension to three - dimension. It is better to use dissection analysis to determine whether an infringement exists and the remedies are suggested to be damages and modification mainly.
