论我国未成年人刑事案件诉讼程序的不足与完善——兼评《刑事诉讼法修正案》的相关规定

On the Problems and Improvement Proposals for China's Juvenile Criminal Procedure——Based on the Regulations of the Amendments of China's Criminal Procedural Law

未成年人刑事诉讼程序是我国《刑事诉讼法修正案》专章规定的程序,其中有许多进步之处,但与国外未成年人刑事诉讼程序的一系列原则制度相比我国该程序还存在不足。在未成年人诉讼程序中应该严格遵守教育为主惩罚为辅的原则、全面贯彻教育感化挽救方针、确立未成年人法庭的合法地位、严格逮捕标准、完善法定代理人制度与监护制度、完善附条件不起诉制度与案卷封存制度,以达到更好的规范我国未成年人刑事诉讼程序、保护未成年人诉讼权利的目的。

The juvenile criminal procedure is specially regulated in China＇s ＂Criminal Procedure Law Amendment＂, which can suggest much progress. However, compared to those abroad, there is some weakness in this procedure. In the juvenile criminal procedure, we must strictly follow the principle of giving the first place to educating and second place to penalty, and carry out the policy of education. In addition, we should give the legal status of juvenile court, tighten the standard of arrest, perfect the system of legal representative and guardianship and improve the system of non - prosecution with additional conditions and the file sealed, aiming to reach the target of better regula- ting the juvenile criminal procedure in our country and protect the juvenile＇s procedural rights.
