Research on the Mechanism of the Dispute Prevention and Multiple Dispute Resolutions of School Sports Competition in China

阐述了我国学校体育竞赛纠纷的概念及类型,分析了纠纷预防与解决机制的现状,从而提出建立预防与多元化解决机制的设想。在此基础上进一步分析提出,选择纠纷预防、调解、仲裁、行政复议、司法诉讼五种机制来构建我国学校体育竞赛纠纷预防和多元化解决机制,并对以上五种机制作了协调定位,最后,对建立该纠纷预防和多元化解决机制提出了具体建议。

The paper explains the conception and type of the dispute and analyzes the status quo of the dispute prevention and resolution mechanism of school sports competition in China, and then puts forward a conceive to set up the dispute prevention and multiple dispute resolution mechanism of school sports competition in China. Furthermore, with a deeper analysis,it brings forward to use the mechanism of prevention of dispute,mediation, arbitration, administrative reconsideration and lawsuit to set up the dispute prevention and multiple dispute resolu- tion mechanism of school sports competition in China, and defines five mechanisms in harmony. Finally, it puts forward concrete suggestions to establish the mechanism of the dispute prevention and multiple dispute resolution of school sports competition in China.
