近年来强制拆迁事件愈演愈烈,目前对强制拆迁的利益动因和危害性的研究基本是空白,对其研究具有理论和现实意义。现今强制拆迁具有目的的日趋非公益性、被拆迁的民众对司法公正性的日趋不信任性、范围的日趋扩大性、参与方的日趋多元性、利益的日趋对立性和过程的日趋暴力对抗性等特点。造成这一现状的有财政动因、升迁动因、个人利益动因、责任动因和人情动因等。其危害性非常大,造成对和谐社会的构建、民生、人权、文化、社会主义信仰等一系列危害,需要采取必要的措施减少强制拆迁及其危害性。

In recent years, forced relocation events are becoming increasingly fierce. The present study on interest incentive and harmfulness of forced relocation is almost vacant. However, such study has theoretical and realistic significance. Presently, the characteristics of forced relocation include： increasingly non-com- monweal purpose, increasingly distrust of people to judicial justice, the increasingly widening range, the participants＇ increasingly diversity, the growing conflicts of interests, the becoming violent confrontation process and so on. The incentives of the current situation consist of the following： finance, promotion, personal in- terest, responsibility and human relations etc. Forced removals are very dangerous, which cause a series harm to the construction of harmonious society, the people＇s livelihood, human rights, culture, socialist beliefs and so on. Necessary measures should be taken to reduce forced relocation and its harmfulness.
