The Evolution of Court Verdict and Its Development in the Song Dynasty

判词作为一种独特文体,其产生、成熟、发展与中国传统文化进程息息相关。宋代是继唐代之后判词史上的又一重要历史阶段,文学性与实用性进一步演化,由拟判演变为实判,由骈文演变为散文,明确引用法律条文作为判决的依据。本文拟对宋代判词的沿革与发展进行探讨,力图呈现其内在脉络和历史轨迹,从社会环境、文学传统和创作主体等方面揭示其演变过程和原因。

As a special style of article, the origin, maturing and developing of court verdict is closely re- lated to the development of Chinese traditional culture, and the Song Dynast was another important stage of the development of court verdict after the Tang Dynasty. Literariness and utility were further developed, simulating verdict became real verdict, and law entries were referenced as evidence. This paper gives an account of the development of verdict text in the Song Dynasty, discusses the evolution process and it causes from aspects such as social environment, literature tradition and the creation subject.
