在现代科学技术的推动下,人们对海域资源的开发利用已经逐渐从平面开发利用向立体开发利用过渡,并开始重视海域资源开发利用的立体性和层次性。首先,文章对海域资源三维多层产权的概念、内涵以及特征进行研究,确定海域资源三维多层产权价值要大于海域资源整体的产权价值;其次,对海域资源三维多层产权体系进行研究,认为海域资源三维多层产权体系是由权利体系、初始配置体系、市场交易体系以及管理保障体系组成,并对产权体系进行分析,以期对海域资源的多层次利用提供理论支持。

With the impulse of the modem science and technology, the development and utilization of the sea resources has been gradually transited from the development of the plane to the development of three-dimensional level, and people start to focus on the three-dimensional and hierarchical development and utilization of sea area resources. First, the paper researches concept, connotation and characteristics of three-dimensional multilayer property of sea resources, and determines that the three-dimensional multilayer property value of sea resources is greater than the property value of the whole sea resources. Second, the paper studies the three-dimensional multilayer property system of sea resources, which contains rights system, the initial allocation system, market system and protection system. The paper also analyzes the property system in order to provide theoretical support for the multilevel utilization of sea resources.
