对我国卫生法学知识生产的一个片段式反思——以知识生产者为视角

A Fragmentary Reflection About Knowledge Producing of Health Law in China——From the Perspective of Knowledge Producers

卫生法学知识生产者的生产能力是决定我国卫生法学发展的重要因素。从建立在数据分析基础上的反思可以发现,目前大量实践部门的知识生产者都比较功利,而来自医学院校或研究机构的生产者则面临学术共同体能否形成、传统法学研究共同体的认可等问题,法学院校的知识生产者还需认真对待知识产出持续性与卫生法学学科构建之间的关系。本文建议通过加强生产者之间实质性合作以解决部分问题:而问题的彻底解决,则需要在卫生法学知识生产的学术体制改革、学术理念开放以及知识生产者激励等方面下功夫。

The capacity of knowledge producers in Health Law is an important factor in the development ofhealth law in China. After reflecting on the data analysis we can find that a large number of knowledge producers from practicing departments are utilitarian; while the producers from medical colleges or research institutes are faced with such problems as the formation of new academic community and the recognition of traditionaljurisprudence research community; anct the prouucc~ ~ ~,-- - relationship between the persistence of knowledge output and discipline construction of health law. In this paper, the author suggests that Strengthening substantive cooperation between the producers may solve part of the problems, whereas ultimate solutions lie in the reform of health law academic system, the publicity of academic concepts and the incentive for producers.
