社会资本与农村社会法治秩序的构建

Social Capital and the Construction of Rule of Law in Rural Society

以关系网络、信任结构、制度规范为内容的社会资本,是法治社会建设的重要动力来源和理论支撑,同时现代法治又为社会资本的积累提供了重要的制度保障。当代中国农村社会正处于传统向现代艰难转型阶段,其社会资本也因此呈现出传统与现代共存的现实形态。农村传统社会资本中诸多不良因素的延续,无疑会给农村社会法治秩序的构建带来诸多障碍。因此,当下农村社会法治建设的关键,乃是要创建有助于法治秩序实现的现代性社会资本。

Social capital, including social relations, trust structure and social norms, is the impor- tant power source and theoretical support for the construction of rule of law, while the rule of law is the important system guarantee for the accumulation of social capital. Contemporary rural socie- ty is in the hard transition stage from the traditional to the modern,therefore the traditional and the modern social capital coexistent in the rural society. The continuation of many adverse factors of traditional social capital undoubtedly are obstacle to the construction of rule of law. Therefore the key of present rural social construction of the rule of law is to create the modern social capital.
