摘要
国际海事组织2009年在香港通过的《2009香港国际安全与无害环境拆船公约》对船舶有害物的管理提出了法律要求。公约对船舶制造、营运管理以及拆船作业进行了规范,对航运界的多个利益方提出了要求。根据公约以及配套的一系列导则要求,对船舶有害物质全生命周期管理的法律责任及风险进行了分析,并对各利益方的具体履约要求进行了梳理,为我国航运界正确履约提供参考。
Based on the concept of "from cradle to grave", the Hong Kong International Convention for the Safe and Environmentally Sound Recycling of Ships adopted in 2009 in Hong Kong, which stipulates a series of regulation to contract governments to the manage the hazardous substances in design, operation and recycling of ships, which re lated to many stakeholders of shipping industry. The legal obligations and risks in the implementation of the Con vention and the related guidelines are analyzed, which provids valuable helps for implementing the Convention.
