摘要
《食品安全法》确立了我国现行"分段监管为主、品种监管为辅"的食品监管体制,但在这一体制下,对食品生产加工小作坊和食品摊贩的监管由于配套法律法规的缺失导致监管职责不清,重复监管、监管盲区十分突出,存在大量的食品安全隐患.本文从食品生产加工小作坊和食品摊贩概念界定入手,分析在商场、超市和集贸市场的食品小作坊、门店销售、生产许可与流通许可竞合与例外方面存在的监管盲区,最后提出卫生行政、质量监督、工商行政管理和食品药品监督管理部门对食品小作坊和食品摊贩的监督管理职责划分建议.
The China Food Safety Law establishes the food supervising system which is a licensing system for the food production, food circulation and catering services. The lack of supplementary regulations causes that the responsibility in different sectors of government is vague, repeated supervision and severe lacks of regulation. The paper first defines the small food production or processing workshops and food vendors, then analyses the lacks of regulation in small food production, processing workshops, the shopping mall, supermarket and trade fairs, at last puts forwards the suggestions on allocating different responsibilities among the administrative department of public health, the quality supervision department, the administrative department of industry, commerce, food and drug administration.
