摘要
不动产登记是公示方法而非确定权属的标准,共同共有不排斥共有关系终止时的按比例分割。对"用共同财产还贷"的法律行为做合目的、习惯以及婚姻法价值取向的解释可以得出结论:《婚姻法解释(三)》之"不动产登记",无论是在确定父母赠与之意思表示时,还是在确定房产是个人财产还是夫妻共同财产时,抑或在夫妻离异时确定房屋产权归属时都只是一种参考,而非标准。
Real estate registration is not the standard to determine the ownership, but the method of publicity. Joint tenancy does not reject the proportional division after the termination of the total rela- tionship. Interpreting the legal acts of using common property of repayment under purpose, habits, and the value of Marriage Law, we can conclude that: the real estate registration in Judicial Explana- tion (Ⅲ) of the Marriage Law is just a reference, rather than the standard to determine the meaning of parents' gift, the personal or jointly owned property, and the ownership of the house.
