黔东南苗族村寨民间调解机制探析

On the Civil Mediation Mechanism of the Hmong Villages in Southeast Guizhou

在充分汲取苗族独特的习惯法规则的基础上,黔东南苗族村寨已形成了以村民调解委员会调解主体为主导、且行之有效的民间调解机制。研究在实证剖析的基础上,认为现代的民间调解机制在逐渐与法律体制内的调解方式接轨过程中,既需要国家司法体制的重视,也仍需要充分挖掘民间调解资源。

On the basis of the unique customary laws of the Hmong or Miao Ethnic Group,people living in the Hmong villages of Southeast Guizhou have formed an effective civil mediation mechanism which takes the Villagers Mediation Committee as the subject.Through the analysis of empirical materials,this article argues that modern civil mediation mechanism is increasingly integrated with the mediation within the legal system and therefore calls for the attention from the judicial system of the country and further exploration of civil mediation resources.
