On the Path of Implementing China's Intellectual Property Strategy under the Rule of Law

中国知识产权立法虽然起步晚,但发展快,并直接与国际接轨,已建立起符合经济社会发展水平和国际通行规则的法律体系。但为了应对世界上的竞争与挑战,保障《国家知识产权战略纲要》的顺利实施,还必须坚持完善具体的法律和保障措施,不断提升依法保护知识产权保护的能力;健全知识产权保护的执法体制,强化知识产权司法保护的主导作用,坚持依法审理各类型知识产权案件,不断加大司法保护力度;健全知识产权审判体制和诉讼制度,提升规范市场竞争秩序的法治能力,构建科学保护的长效机制,切实推进创新型国家建设。

Legal protection of intellectual property rights in China started late but developed rapidly, which works directly with international standards and has established a legal system in line with economic and social development and international rules. To deal with challenges and to ensure the smooth implementation of the National Intellectual Property Strategy Outline, it is essential to adhere to improving the protection of intellectual property protection in accordance with the law and enhancing the enforcement of intellectual property protection system. Strengthening the leading role of judicial protection of intellectual property rights and insisting on hearing the cases of all types of intellectual property in accordance with the law are helpful to increase judicial protection. Long- term mechanism of scientific protection will promote the innovative nation-building.
