摘要
法律和事实以全面的、持久不懈的行动谋求劳动公平之实现,是当代世界不可抗拒的历史潮流。文章针对我国愈演愈烈的就业歧视现象,通过对就业歧视的基本界定,追溯其理论根源,对我国反就业歧视立法进行反思。同时,借鉴域外先进立法模式,从法的效能角度出发,对立法提出建议,以更好地保障劳动权公平,促进社会和谐发展。
The persistent pursuit of working equality,inters of law and fact is a major his- torical trend. According to the more and more severe situation of employment discrimination in China, it is proposed that anti-working discrimination should be considered at the level of legis- lation. The paper, considering the theoretical base of working discrimination, give suggestions a- bout legislation with the practice in foreign countries as reference from the angle of law efficien- cy,in order to protect people's right of working and promote social harmony.
