关于我国实施网络实名制的探讨

Implementation of Network Real-name System in China

网络的虚拟性和网络匿名制在很大程度上导致了某些网络行为的失范,对现实中公民的合法权益、社会利益以及国家利益产生很大影响,而网络实名制在促进网民自律、打击网络违法犯罪、净化网络环境等方面具有重要意义。作为世界上实施网络实名制最成功的国家,韩国的经验给了人们有益的启示。我国网络实名制应当在完善相关法律法规、完善相关技术的基础上分网站、分板块逐步推行,在实施模式方面,应该采取有别于韩国的改良的间接实名制。

The virtual nature, as well as the practice of anonymous system, results in inter- net crime and anomie, which does harm to people＇ s legal right, social harmony, and the national interest. Using the real name system to regulate the internet access is an efficient way to pro- mote people＇s self-discipline against internet crime. Korea is one of the most successful coun- tries that use the real name system for internet access. Their experience could be a good refer- ence. It is also pointed out in this paper that China should make related law before using the real name system. An indirect real name system is recommended to carry out gradually to some websites technically ready.
