我国内地人民陪审员制度的完善

On the Improvement of the People's Jury System in the Local Courts of Our Country

我国人民陪审制度存废之争并存。该文通过分析其原因,并借鉴香港陪审制,提出弥补和完善我国人民陪审制度不足的可行性建议,以期实现人民陪审制度的司法民主、权力制约和审判监督的功能。专家陪审员既要保持大陆法系陪审制特色,又要吸收香港陪审团制度优点,这是可行的改革方向。

Reserving or abolishing the people＇s jury system still remains a debate in our country. This paper, by analyzing the causes of this debate and taking into account Hongkong＇s jury system, puts forward suggestions about the feasibility of amending and improving the people＇s jury system in our country in order to realize the functions judicial democracy, power control and trail supervi- sion. The expert jurors should not only maintain the characteristics of civil law system but also absorb the advantages Hongkong＂ s jury system, which would be a practicable direction of the reform.
