公安边防执法中士官的角色定位及规范

Non-commissioned Officers’ Roles and Norms in Border Defense Law Enforcement

随着我国法治进程的深入推进,在边防执法工作中,有限的警官警力与繁重的执法任务的矛盾日益凸显,士官参与边防执法势在必行。但士官由于缺乏法律的明确规定,其在边防执法工作中的地位一直受到了质疑,只做不说、只看效果不看授权,成为士官在边防执法中的基本生存样态。文章认为,可以尝试通过公安部的部门统筹立法途径,对公安边防执法中的士官进行定位和规范,从而建构士官参与边防执法的合法性基础。

With the further advance in the process of law administration in our country, conflicts between limited police forces and heavy tasks has arisen gradually in the work of border defense law enforcement. It is imperative for non-commissioned officers to participate in the law enforcement. However, But non-commissioned officers＇ roles in law enforcement are questioned because of lack of clear law provisions. The basic status of non-commissioned officers is only to do, but not to say, or only to see effect not authorization. This article suggests public security organs to establish non-commissioned officers＇ roles and norms in law enforcement by way of legislation in order to construct the legal foundation of participating in the law enforcement.
