著作人身权的合理流转

A View on the Properly Circulation of Copyright-Related Personal Rights

长期以来,人们认为:著作人身权不能转让、不能与作者相分离。本文从我国当前发展的实践需要出发,探讨了著作人身权合理流转的可能性和必要性,并就这一问题提出了允许合理流转、制止不合理流转的立法建议。

It is long accepted that moral fights for hook can not be transferred nor can be separated from the author. This paper discusses the possibility and necessity of the reasonable transference about moral fights for book under the current practice of China. This paper also offers legislative proposals on the allowance of reasonable transference and the prohibition of unreasonable transference.
