论法治的妥协性

On the Compromise of Rule by Law

法治是利益妥协的产物,而个体的分散意志经过妥协形成的法律是对各方利益的均衡。故阶级斗争思维与法治精神相去甚远。民主是多数人的政治,但多数人的权利亦须受到制约,这是由法治的妥协机制所决定的。以权利制约权力、分权制衡体现了法治的妥协性,同时法治的妥协性还体现为对传统的尊重和让步。

Rule by law comes from the compromise of benefits,but the law after the compromise is a balance of benefits.It may be said that thinking of class struggle is far away from legal spirit.Democracy is politics belonging to the most people,but the rights of the most people must be restrained,which is decided by the compromise of rule by law.Restraining rights with rights and balance by division of rights reflects the compromise of rule by law,and at the same time the compromise of rule by law reflects respect to tradition.
