恢复性司法理念下社区矫正效果评价体系研究

Studies on Community Correction Effect Evaluation System under the Recoverable Judicial Idea

恢复性司法的核心内容就是动员全社会力量,吸收被害人和犯罪嫌疑人所在的社区参与到对犯罪的惩治程序中来,其主要特征在于恢复性。在恢复性司法理念下,社区矫正效果的评价体系首先需体现被害人的意愿,以使其真正走出犯罪伤害的阴影,恢复被损害的精神创伤;其次需认真对待社区居民对矫正对象改造效果的评价,重视他们对矫正对象改造的满意程度,恢复被损害的人际关系;再者需将矫正对象所在单位及亲友对其的评价列入评价体系,以使评价结论更客观、公正,恢复被损害的社会秩序。

The core of recoverable judicature is to mobilize the social forces of the community to correct the criminal offenses,whose characteristic is recoverable.First,under the recoverable judicial idea,the desire of the victims should be reflect in this community correction effect evaluation system.Second,the effect evaluation of correction object should be taken seriously and degree of satisfaction with the correction object should be attached importance to so as to recover the relationship between the victim and the correction object.Third,colleagues and relatives of the correction object are invited to participate in the effect evaluation system to make the result objective and fair so as to recover the disordered social order.
