农村宅基地使用权流转之政府规制

Government on the Transfer Regulation of Rural Residential Land Use Right

目前我国法律对农村宅基地使用权流转原则上是禁止的,但宅地基使用权的私下流转却非常普遍。苏州、天津、成都等地区积极开展了改革农村宅基地使用权流转的实践,并取得了一些成效。但是,目前宅基地使用权流转混乱,需要政府加以规制,而政府在宅基地使用权流转中的职能缺失主要体现在法律法规缺失、登记制度缺失、服务职能缺失和监管职能缺失等。因此,建议通过完善立法、健全登记、强化服务、加强监管来规范、推动、促进、保障宅基地使用权的流转。

It is prohibited on the rural land use right transfer in the China＇ s law, but private circulation is very common. Suzhou,Tianjin, Chengdu and other areas actively carried out the reform of rural land use right transfer,and had made some progresses. Confusion homestead usage right of the status quo needs the government regulation. But the lack of the functions of govemment circulation in the land use right is mainly reflected in the lack of laws and regulations, the absence of a registration system, the lack of service functions, the lack of regulatory functions etc. The author proposes through perfecting legislation,improving the registration, and enhancing service, strengthening the supervision to regulate, promote, prorate, safeguard the transter of land use right.
