消防行政执法中强制执行权新论

On the Law Enforcement of Fire Administration

通过对消防行政强制执行的内容、法律依据、法律原则及所遵循的法律程序等进行深入研究。结合新颁布的《中华人民共和国行政强制法》,并根据当前的执法现状,分析了我国消防行政强制执行中存在的问题,提出了在完善和修订法规的基础上,细化消防强制执行程序和建立专业强制执行队伍,并通过转变执法角度、不断创新执法手段等措施,以确保公民合法权益在消防行政强制执行过程中不受或少受损害,树立消防行政强制主体良好的执法形象。

This paper makes a thorough study of the content, laws, law principles and procedures in fire law enforce- ment. It also analyzes the status quo of fire law enforcement, the problems with this enforcement based on Adminis- trative Compulsive Law of the People＇s Republic of China. Some suggestions are offered to detail the procedures and changes of law enforcement to insure the interests of the people in the course of administrative compulsion.
