With a comparison of diplomatic protection and consular protection, this article discusses different functions of the two in international law, aiming to explore how to develop international law, how to have it better adjust different relations around the globe in the new situation, and especially how to bring it to greater play in protecting nationals＇ legal rights and interests and personal safety overseas. The best ways to protect nationals＇ overseas safety include a breakthrough of the limit of traditional approach to intemational law in diplomatic protection and efficient utilization of consular protection, as well as fast and independent domestic legislation.
