我国外贸中小企业国际保理中的困境及法律对策

国际保理是国际贸易中一种新兴的结算方式,可有效解决出口贸易融资难题,有效降低货款回收风险,对促进我国外贸中小企业发展具有重要意义。但是,由于法律制度的供给和运行环境存在很多问题,挫伤了我国中小企业开展保理业务的积极性。为破解困境,既需要中小企业自身的努力,也需要从法律上积极应对,需要完善相关法律制度,建立信用管理法律体系,加强对国际保理业务的法律认识,规范保理收费,建立商业银行分担风险制度。

International factoring is a new instrument of settlement in international trade. Chinese medium-sized and small enterprises can get more financing and reduce the risk of loan recovery by using it. It is of great significance for the development of Chinese SMEs in international trade, But problems with the law system and the environment hindered the SMEs from developing international factoring. To solve this problem, we should not only encourage the SMEs, but also search for answers for that in terms of the improvement of the law system, the establishment of the law system for credit management, the understanding of international factoring, the standardization of charges of international factoring and the establishment of risk sharing system of commercial banks.
