摘要
我国已初步建立适合本国国情的公共权力监督体制和制度体系,但制度自身的内在缺陷影响了制度绩效:对权力的公共属性认识不足,监督的目的更多在于保证权力意志的贯彻,而不是限权控权;重视教育的引导、榜样和典型的感召,忽视制度对个人自身利益的有效激励;缺乏宏观性制度使监督的权威性不够;制度建设缺乏程序性,导致制度执行的不确定性与随意性,使制度功能发挥受到很大制约。为此必须合理界定公共权力边界,在制度的思想基础、层次性、程序性上作更多改进,以最大限度地发挥制度的效能,进一步推动反腐倡廉工作。
Our country has generally established a public-power oversight system,whose inherent defects have,however,affected its necessary performance: with less correct understanding of its public implications,the oversight would rather ensure the exercise of the power than limit and check it;more importance is attached to the inspiration from education,typical examples and representatives,while the effective incentive to drive personal interest was ignored;the absence of macro institution led to inferior authority;the irregular system building caused incertitude and casualness of the system operation,and the function of the system was greatly restricted.In order to maximize its effectiveness and to further promote the anti-corruption work,it is necessary to set a reasonable definition boundary of public power,and to make more improvements on its ideological basis,operating dimensions,and programs as well.
