On the Issues of International Law in Use of Force against the Somali Pirates

2008年以来,基于索马里海域海盗十分猖獗,并威胁到该地区国际航运的安全,联合国安理会陆续通过第1816号等一系列决议,授权各会员国海军在征得索马里过渡政府的同意下使用武力打击索马里海盗。然而,联合国通过授权使用武力的方式来打击海盗存在诸多国际法问题,主要包括索马里海盗成为武力打击对象的合法性问题、使用武力打击索马里海盗的有效性问题以及索马里海盗被抓后的普遍管辖权问题,这些问题将促使联合国集体安全制度实现从现有只注重传统安全观到兼顾非传统安全观的转型。

Since 2008, because of the incidents of piracy and armed robbery against vessels in the territorial waters of Somalia and the high seas off the coast of Somalia exacerbate the situation in Somalia which continues to constitute a threat to international peace and security in the region, the UN Security Council has adopted the Resolution 1816 （2008） and so on. That is, each member may enter the territorial waters of Somalia for the purpose of repressing acts of piracy and armed robbery at sea, in a manner consistent with such action permitted on the high seas with respect to piracy under relevant interna- tional law. However, during the use of force against the Somali Pirates, there are many questions of international law, which includes the legality of use of force against the Somali pirates, the validity of use of force against the Somali pirates and the universal jurisdiction after the Somali Pirates being arrested. These questions will prompt the transformation of the UN Collective security system from the existing traditional security concept to pay atlentiont to the non - traditional security concept.
