摘要
产权式酒店重建引起的法律问题主要包括:如何协调各方的利益,即如何在保障多数业主利益的同时保护异议业主的利益,实现效率与公平的兼顾;如何实现开发商与业主之间利益的平衡,以及抵押权人的权利如何保障等。对产权式酒店的重建问题,目前没有专门的法律进行规范。文章建议在以《物权法》为规制的基础上借鉴公司的相关治理制度对这些问题进行分析,并提出了相应的解决途径,以此平衡各方当事人的利益,保证酒店重建工作的顺利进行。
Legal issues caused by reconstruction of property type hotel chiefly include that how to coordinate the interests of all parties, namely how to safeguard the interests of owners of the objection most while protecting the interests of owners, realize efficiency and fair consideration; how to realize the balance of :interests between developers and owners; mortgagee~ fight to security. On the hotel property reconstruction problem, there are no special legal norms. The author suggests that we could analyze these issues based on Real Right Law and related management regulations, also puts forward some corresponding solutions in order to balance the interests of the parties and make the hotel reconstruction work to proceed smoothly.
