摘要
2009年2月《食品安全法》的颁布,标志着我国食品安全保障进入了一个全新的法治时代。食品安全问题的复杂性和多样性决定了仅靠立法是不够的,还必须善于把科学的立法付诸实施,并在这一过程中检验、完善既有法律体系。由于在食品安全领域消费者的弱势地位,行政监管法律制度应当扮演更为重要的角色,同时,对于国外较为完备的食品安全监管机制也应进行必要的分析和借鉴。
Promulgated in February 2009,the Food Security Law of People’s Republic of China indicates that the safeguard of food security in China entering a new era of rule by law.The complexity and diversity of food security issues destine that legislation alone is not enough,scientific legislation must be carried into execution actively,during which existing legal system can be tested and improved.Due to the weak position of consumers in the field of food security,the legal instituion of administrative supervision should play a more important role,as well as fulfill essencial analysis and reference on the more perfect supervision mechanism of food security in foreign countries.
