中国公民现代法律意识培养之生成基础与路径选择——以中国特色社会主义法律体系的形成为视角

On the Foundation and Routes of Cultivating Modern Legal Consciousness of Chinese Citizens——Analyzing the Formation of Socialist Legal System with Chinese Characteristics

公民现代法律意识不仅是我国现代社会公民意识的核心内容,而且也是正在和平崛起的中国建设社会主义法治国家不可或缺的条件。法律的生命力在于实施。我国虽已如期形成了中国特色社会主义法律体系,但整体法治建设与公民法律意识培养是不同步的,培养和提升我国公民新型的现代法律意识仍然任重而道远。我们必须在充分了解公民现代法律意识理论的基础上,从我国公民法律意识的实际现状出发,吸收与借鉴人类法律文化成果中法律意识培养、法治观念树立的有益因素,力求在中国法制改革道路的模式选择框架中,深入探究中国公民法律意识的生成土壤。应该清醒地认识到,培养我国公民现代法律意识是一项庞大而复杂的社会系统工程,必须把这项工作制度化和长期化,采取积极有效的措施和途径进行有计划、有目的教育和培养。

Modem legal consciousness is not only the core of civil awareness in a modem civil society, but also an indispensable premise for the peaceful rising China to construct a socialist country ruled by law. The vitality of a law lies in its implementation. Although China has formed a Socialist legal system with Chinese char- acteristics on schedule, the overall rule of law and civil law consciousness is not synchronized, and training and promoting a new type of modem legal consciousness of citizens is still a long -term and arduous task. We must fully understand the theory of modem legal consciousness of citizens ; analyzing the actual current situation of the legal consciousness of Chinese citizens ; absorb the legal and cultural achievements of human cultures in the legal sense or the useful factors set by the rule of law, and probe into the fomlational soil of the legal consciousness of Chinese citizens from the mode framework of the legal system in China. It should be recognized soberly that the cultivation of modem legal consciousness of our citizens is a large and complex social system project and it is required to institutionalize this work and take positive and effective measures to carry out a planned education and training process.
