On the Legal Property of Punitive Damages System

在理论界,惩罚性赔偿制度有被滥用之虞。首先分析了关于惩罚性赔偿制度法域属性的三种观点:即民事法律制度说、准刑事处罚说、经济法制度说,进而主张惩罚性赔偿制度的法律属性为社会性———经济法法域内的一种特性,并从该制度产生的根源、功能、限制等层面深入分析了惩罚性赔偿制度的社会性法律属性。

Punitive damages system is in danger of being abused in theoretical circles. So, this paper first analyzes the three views of the legal field property of the punitive damages system： civil law system, quasi - criminal penalties and economic law system. And then it advocates that the social property is the punitive dama- ges system＇s basic legal property--a feature in the economic law field. Finally, it makes a thorogh analysis of the social property--the punitive damages system＇ s legal property from the root causes of the system, the func- tion, the restrictions and other aspects.
