矿产资源产权理论的基础与现实意义

Fundamental and practical significance of property rights of mineral resources

当前,矿产资源产权理论仅局限于矿产资源所有权的派生权范畴,未能从多个角度对共生权、伴生权、相邻权及其他派生权进行深入的剖析。本文以现代产权理论为基本参照,对矿产资源产权进行分解定位,为制定矿产资源产业政策及法律法规的重要理论基础。

Now, property rights theory of mineral resources only belong to the domain of derived rights of ownership of mineral resources, otherwise it could not analyze deeply symbiosis right, associated rights, adjacent relation and other derived rights from different dimension. In this paper, according to the modern theory of property rights, the authors explain the property rights of mineral resources, it provides the important theoretical basis of making up industry policies and law regulation of mineral resources.
