台湾地区高等教育法制的发展状况及启示

The Development of Higher Education Law in Taiwan and the Illumination

台湾地区高等教育法制的历史发展,历经日据时期、国民政府戒严时期和解严后时期三个阶段的变革,逐渐形成了以学术自由和大学自治为核心的现代大学制度体系。在社会转型时期,台湾的高等教育通过大学法的修订启动改革,以大学内部组织结构和人事制度改革为切入点,通过司法审查和大法官解释等法律实践活动逐渐推进高等教育法制的发展。这对我们正在进行的中国特色现代大学制度建设和我国高等教育法制发展均有重要的参考意义和启示作用。

There are three stages in Taiwan＇s history of higher education law： Japanese rule, Koumintang＇s rule under martial law and democratic period. The modem university system involving academic freedom and college autonomy has grown up in Taiwan. During social transformation, Taiwan＇s higher education reformation has been promoted well： starting with legislation of college law, caring especially about college internal framework and personnel innovation, realizing higher education law by such legal practice as judicial review and Taiwan Grand Justices. We could refer to the development of Taiwan more when we establish our Chinese characteristic modern university system and develop our higher education law.
