对我国影子银行的产生、现状与法律监管的思考

A consideration about the appearing,present situation and legal supervision of the shadow bank in China

在对影子银行的概念、特征及表现形式进行解析的基础上,分析了影子银行在我国出现的原因及对我国经济的双重作用,进而对我国影子银行法律监管制度进行评价。认为应当制定、完善影子银行的相关法律,使其处于监管之下,明确影子银行的信息披露义务。

Based on illustration of the definition, characteristics and types of the shadow bank in China at present, the causes of the shadow bank appearing in China and its positive and negative roles in China economy are analyzed. Meanwhile the legal supervision system for the shadow bank in China is evaluated. Accordingly it is held that the law about the shadow bank should be worked out and perfected and let it be under legal supervision, and the obligation of shadow bank to reveal information should be made clear.
