摘要
本文借助发生在凉山彝族地区的三个案例,将国家法与习惯法的关系还原到具体情境中去观察和讨论。文章指出,在规范文本乃至法律运作的现实过程中,由于知识系统、价值观念及具体程序性等差异,国家法与彝族习惯法之间的断裂和冲突现实存在;但同时,在纠纷解决活动中,当事人,第三方"德古"甚至包括国家司法机关在内,都并非囿于二元化的思维模式,而是体现出多元化的规范或权威之间相互利用、配合和弥补的趋势。我们需对学术话语所建构的二元分离加以反思,而超越"二元"模式的真正契机往往不是从立法领域,而是从司法及法律实践领域开始的。
With the help of three cases occurred in Liangshan Yi area,this article can observe and discuss the relationship of state law and customary law in a specific context.The article points out,because of the differences in knowledge systems,values and specific procedure,the fracture and post-conflict really exist in specification text and even the operation of the law between the State Law and Yi's customary law.But at the same time,the parties,the third party 'De Gu',and even the national judicial authority in the activities of dispute resolution are not limited to the dualistic way of thinking,but rather use a wide range of specifications or authority to meet and make up each other.The author thinks that we need to reflect the binary separation to be constructed in the academic discourse,while beyond the real opportunity of the 'binary' mode more often than not from the area of legislation,but from the judicial and legal practice areas.
