On Litigation-Prevention Function of the Court——Perspective of Social Management Innovation

法院推动社会管理创新的一个重要途径就是法院职能的延伸,而诉讼预防功能的发挥应该是其重要的组成部分。诉讼预防功能包括了纠纷发生之前的社会矛盾源头治理,以及诉讼前的纠纷分流途径。诉讼预防功能的发挥具有现实和理论意义,但应该以司法的中立性和服务审判职能为界限。

An important way for the court to promote social management innovation is the enlargement of itsfunction and the function of litigation-prevention is an important part of it. The function of litigation-prevention in- cludes controlling and managing social conflicts before disputes happen and dispute guidance before litigation. Litiga-tion-prevention function, though meaningful in both reality and theory, should be subjected to judicial neutrality and the court＇ s function of serving judgment.
