EU Countries′ Culture Legislation and Its Lessons for China

欧盟各国立法保护文化发展并非简单保护文化事务和文化现象,而是与欧盟的形成、成员国间文化交流、加强欧盟国际影响等因素密切相关。欧盟国家重视文化立法的战略地位,建立了体系完善、层次清晰、内容丰富的文化法律体系和文化保障措施,文化立法层级高、范围广、内容细;注重文化特殊性和多样性;注重文化立法的时代性、地域性和渐进性。我国可借鉴欧盟各国在文化立法方面的经验,重视文化立法战略地位,提高文化立法层级、扩大文化立法范围,注重文化立法的本土性和渐进性,逐步建立健全我国社会主义文化法律体系,不断增强我国文化软实力的国际竞争力。

EU Countries＇ Culture legislation does not simply aim to protect its culture affairs and culture phenomena, but also it is closely related to the formation of the European Union, culture exchanges and to strengthen the EU＇s international influence and other factors. EU countries attach importance to the strategic position of the cuhural legislation and establish a cultural legal sys- tem, which is characteristics with high level of cultural legislation, a wide range of fine content ; emphasis on cultural specificity and diversity; focus on cultural legislation of the times, regional and progressive. Learning from the experience of EU countries＇ culture legislation, China should pay more attention to the strategic position of culture legislation, improve culture legislative level and expand the range of culture legislation, focus on local and progressive culture factors, gradually establish and improve China socialist culture legal system, continuously enhance the international competitiveness of China＇s culture soft power.
