关于电子健康档案相关权利的思考

电子健康档案是记录居民健康信息的系统化文件,是社区卫生服务中收集、记录社区居民健康信息的重要工具。本文对电子健康档案各个相关主体在法律上的权利和责任归属问题进行探讨,对所有权、使用权、管理权三者进行分析比较,指出电子健康档案建设在相关法律规范方面需要完善,并提出相应的对策和建议。

The electronic health records （EHR） are systematic files to record the health information of residents. They are important tools to collect and record the community residents＇ health information and to manage their health in community medical service. In this paper, the legal rights and responsibilities of each relevant subject of electronic health records were investigated. After comparing ownership, right of use, management right, it defines the content and scope of the three rights above-mentioned relevant to EHR and the relationship between relevant subjects and the three rights. It aims to provide reference for development and utilization of EHR in the future, and measures and suggestions on policy and legal protection for health information construction.
