摘要
研究政府投资项目的两种业主组织模式所对应的契约结构,并对不同契约关系和契约结构存在的委托-代理风险进行实证分析。研究表明,两种模式的契约结构存在较大差异。在业主市场代理模式下,业主与市场主体之间的一系列契约是纯市场主体间的经济契约,而业主行政代理模式下,业主与市场主体间的一系列契约属于行政性经济契约。行政性经济契约下委托-代理风险大于经济契约下的相应风险。
The paper makes a study on the contract structure of government investment projects in two kind of own- er agent mode, and then analyzes the principal-agent risks under different contract relationship and contract struc- ture. The result shows that the contract structures under two modes have big difference. Under the owner market a- gent mode, contract relationships between owner and market subjects are economic contracts between market sub- jects, but under the owner administration agent mode, they are administrative contracts. The principal-agent risk in administrative contracts is higher than that in pure economic contracts.
