摘要
承包商与业主方签订固定价格合同后,能否因物价上涨而获得价款补偿的争议焦点为上涨幅度是否达到物价异常波动标准。针对此问题结合文献、案例和相关法规进行充分研究,给出物价波动同时达到单项要素价格综合波动幅度标准以及合同总价波动幅度标准时才能界定为物价异常波动的结论和相关波动幅度。
After signing a fixed-price contract between the contractor and the owner, contractor can or not obtain the compensation from contract providers for the rise of the price, the biggest argument of this problem is whether the price fluctuation range reaches the level of abnormal price fluctuations. Combined with literatures, cases and relevant laws to analyze, gives the conclusion that abnormal price fluctuation happens when price fluctuation range reaches both the level of single element price fluctuation and the level of contract total price fluctuation.
