Rational Argument and Procedural Requirement for Administrative Decision Hearing In Terms of Discourse Theory

重大行政决策的听证主要包括政策类、规划类和项目类听证。它们的共同特征在于,以理性论辩的方式确认体现公共利益的公共目标,以此限制行政决策权的恣意。在听证程序设计中,需将理性论辩的要求渗透到相应的程序规定中,即,有利于广泛参与的程序准入规定;有利于充分论辩的程序权利规定;有利于认真反思的程序角色规定;有利于结论自治的程序终结规定。

Administrative decision hearing is mainly concerned with policies,planning and programs.Such hearings are held to determine the objectives to embody public interests by means of rational argumentation to restrict the arbitrariness in administrative decision.Rational requirements are to be given expression in the relevant design of hearing proceedings to the benefit of an admission of broad participation,a guarantee to the right of full argumentation,a serious reflection on procedural roles and an end of self-controlled conclusions.
