摘要
残疾人受教育权的法律救济体现了社会正义和人权保障的理念。我国针对残疾人受教育权救济的法律体系和组织机构逐步健全,但仍存在司法救济缺乏法律依据、行政救济缺乏可操作性、其他救济方式发展不完善的问题。应加快相关立法进程,提高立法质量,完善法律救济的程序和机制,启动宪法救济制度,增强残疾人法律维权意识,以此保障残疾人受教育权的实现。
The legal remedy for disabled persons' right to education reflects the concepts of social justice and human rights protection. In China, the legal system and organizations for the remedy for disabled persons' right to education have been gradually improved, but there are still problems to be tackled: the insufficient legal basis of judicial remedy, the inoperability of administrative remedy, and the imperfection of other remedies. Therefore, it is necessary to speed up legislation, perfect the procedures and mechanisms of legal remedies, start the consti- tutional remedy, and enhance disabled persons' awareness of legitimate rights protection, for the purpose of guar- anteeing disabled persons' right to education.
