论受教育权纠纷及其解决机制的重构——以高等教育为视角

On the Disputes of Educated Right and Its Solution Mechanism Reconstruction——From the Perspective of Higher Education

受教育权是公民享有的一项基本权利。在实践中,由于教育思维及受教育权纠纷解决机制方面的原因,出现了诸多的受教育权纠纷。要化解受教育权纠纷,就需要对受教育权、受教育权涉及的法律关系、受教育权纠纷的性质等问题进行梳理,厘清受教育权涉及的法律关系,明确界定受教育权纠纷所属的性质,进而寻找产生纠纷的原因,分析我国现有受教育权纠纷解决机制存在的缺陷,并构建一个包括协商交涉、申诉、诉讼在内的完整的、规范化的解纷机制,以实现校园和谐。

The educated fight is a fundamental fight of citizens. In practice, colleges and universities encounter a lot of disputes about the fight of education, and the reasons are very complex. To resolve the fight of education disputes, we need to sort out the fight of education and their disputes involving the legal relationships, define the quality of disputes clearly, and then to look for the causes of disputes, analyzing the existing defects about solution mechanism of our country for the fight of education disputes, and to build a complete, standardized dispute settlement mechanism including consultation, appeals,litigation,in order to achieve a harmonious campus.
