论我国网络著作权法律保护之缺陷及其完善

互联网的飞速发展在为人们带来极大便利的同时,也为著作权保护带来了诸多困扰。在网络著作权保护方面,我国先后出台了一系列法律、法规与司法解释,为网络著作权的保护发挥了良好的规范作用。但是,该体系仍然存在诸多不足,权益失衡情况依然存在,尤其在归责原则、损害赔偿、授权机制、权利限制等方面尚需进一步完善。对此,应该采用过错推定原则,建立惩罚性赔偿机制,通过市场途径寻求授权许可,进一步扩大合理使用与法定许可的范围并规范其适用方式等措施,使我国网络著作权保护的法律体系逐步走向成熟。

The rapid development of internet has brought people with extremely convenience at the same time has brought the copyright protection with much puzzling. In term of internet copyright protection, our country has successively published a series of laws, regulations, and judicial interpretation, which play good standardized role in internet copyright protection. However, the system still exposes a lot of deficiency, for instance, unbalanced rights and interests, in particular, imputation principle, damage compensation, licensing scheme, and rights restrictions need to be further improved. Thus, it is imperative to adopt the principle of fault presumption, establish the mechanism of punitive compensation, seek the permission through market, further expand the scope of reasonable utilization and legal permission and standardize their applicable ap- proach so as to gradually realize the maturity of legal system of our country＇s internet copyright protection.
