我国部分地区医疗纠纷第三方调解机制调查分析

Investigation on the mechanism for third-party mediation in medical dispute in some provinces

目的:对我国部分地区医疗纠纷第三方调解机制的现状进行比较分析。方法:采用焦点组访谈和个人深入访谈方法,对医疗纠纷第三方调解机构等相关部门的负责人进行访谈。结果:我国形成了以医疗纠纷人民调解委员会为主的多元化医疗纠纷调解机制,调解作为医疗纠纷的一种解决方式,对化解医患矛盾,维护医患关系起到了重要作用,但第三方调解在资金、人员及社会认知方面存在一些问题。结论:不断完善医疗纠纷第三方调解机制,更好地发挥其在医疗纠纷解决中的作用。

Objectives： To analyze the current status of mechanism for third-party mediation in medical dispute in some provinces.Methods： With focus group discussion and individual depth interview,directors of medical dispute third-party mediation department in some provinces were interviewed.Results： Medical Dispute Peoples Meditation Committee（MDMC） based diverse dispute resolution mechanisms have been established.As a method of alternative dispute resolution（ADR）,the third-party mediation holds great promise in resolving medical malpractice and maintaining the harmonious doctor-patient relationship.However,third-party mediation also faces some challenges,such as finance,staff and social cognition.Conclusions： Third-party mediation in medical dispute is needed to be continuously improved to play better roles on medical dispute solution.
