我国社会救助保障公民社会权的不足——基于城乡社会救助实施的随机访谈

Inadequate Givil Right Proteced by Social Assistance in China——Random Interviews Based on the Implementation of Urban and Rural Social Assistance

社会救助在我国是最基础、最有效的公民社会权救济模式,笔者在对社会救助实施中相关人员的随机访谈后发现,我国社会救助在保障公民社会权方面存有众多不足,主要表现为社会救助不以保障公民社会权为初衷,二者严重脱节;社会救助中自由裁量权使用空间过大;物质保障的过于单一、水平太低;精神保障层面的基本缺失。这些已影响到公民社会权保障的推进,阻碍着社会救助制度的完善,损伤到整个社会的公平、正义。

Social assistance in China is the most basic and most effective model of civil social right, but the writer shows, according to random interviews, that there are many deficiencies in civil right protection by social assistance, such as social assistance divorced from civil right; single and low-level guarantee and shortage of mental guarantee, which have influenced the guarantee of civil social right and implementation of social assistance system.
