Legal Issues of Share Transfer of Rural Contracted Land Management Rights

农村土地承包经营权入股流转是当前我国学界和决策界共同关注的一个话题。通过我国土地承包经营权入股流转现有三种实践模式优、缺点的分析研究,得出当下可行的土地承包经营权流转模式为入股农民专业合作社。指出了入股农民专业合作社存在的现实障碍和法律困境,并提出了对策及建议。

Shares transfer of management rights of rural contracted land is a heated topic in the academic and decision- making field. Through the analysis of advantages and disadvantages of the three patterns of shares transfer of rural con- tracted land management rights in China, the paper comes to the conclusion that the existing feasible transfer model is the shares-holding farmer specialized cooperative. It points out the existing obstacles and legal dilemmas, and then put for- ward some countermeasures and suggestions.
