论我国汽车召回制度的完善——以《汽车产品召回监督管理条例》(征求意见稿)为视角

On Perfection of the Automobile Recall System of Our Country — With the Automobile Products Recall Supervision and Management Regulations(drafts) as the Angle of View

丰田公司之所以在汽车召回方面肆无忌惮地漠视世界上第一大汽车消费国——中国的消费者的合法权益,除应该谴责丰田公司无良外,我们更应该对我国汽车召回制度进行深刻的反思。《汽车产品召回监督管理条例》(征求意见稿)有了一定的进步,但仍存在一定的不足。需要通过以下措施完善我国汽车召回制度。一是提高汽车召回法的位阶,制定汽车召回法;二是明确汽车缺陷的认定标准;三是设立中立、公正、权威的汽车缺陷检测认定机构;四是完善汽车召回过程中信息公开制度;五是进一步完善汽车召回法律责任。

Toyota Company is disregard of the world＇ s largest car consumers -- China consumers＇ legal rights and interests in car recall. Toyota should be condemned for its bad act, we should give a profound reflection on China automobile recall system. The Automobile Products Recall Supervision and Management Regulations （drafts） has a certain progress, but it still has some shortcomings. The following measures shall be taken to perfect our country~ car recall system. One is to enhance the status of car recall regulation, formulate car recall law; two is to make clear the car defects standards; three is to set up neutral, justice, and authority institutions for the car defect in- spection; four is to make the information openness system in the perfect car recall process ; Five is to make perfect legal responsibility of car recall.
