法律不可忽视的一面——未成年学生侵犯教师人身权之思考

A Phenomenon cannot be Ignored by Law——Reflect on Infringement of Teachers'Personal Rights by Minor Students

近年来,中小学生辱骂、殴打教师等侵犯教师人身权利的行为屡见不鲜,令人深思。究其原因,与我国相关法律制度的不完善有很大的关系。教师的人身权缺乏法律保护;教师权利的规定笼统模糊;侵权者未得到应有的惩罚;未成年人法制教育失衡,这些因素都在很大程度上助长了未成年学生的侵权行为。因此,完善教育立法,明确教师的权利,给侵权者以适当的法律惩处并全面加强法制教育,对维护教师人身权利和人格尊严,树立教师权威,保障教育事业的顺利发展有着非常重要的意义。

In recent years, it is thought-provoking that teachers＇ personal rights are frequently violated by primary and secondary students, such as abuse or assault. The reason has a lot to do with China＇s legal system. The personal rights of the teachers lacking of legal protection, the definition of teachers＇ rights were blurring; infiingers have not been duly pun- ished, imbalance in the legal education of minors, these factors have largely contributed to the infringement of minor stu- dents. Therefore, to perfect the educational legislation, to clear the rights of teachers, to punish the infringers properly in legal way and to strengthen their legal education have a very important significance to ensure the smooth development of education, maintain teachers＇ personal rights and personal dignity, and establish the authority of teachers.
