民间体育非物质文化遗产的法律保护研究——以山西忻州挠羊赛为视角

The Legal Protection of Intangible Cultural Heritage of Folk Sports——Taking Naoyang Wrestling of Shanxi Xinzhou as Case Study

随着我国经济的迅速发展,民间体育非物质文化遗产受到了前所未有的冲击,面临着尴尬的困境。幸运的是,国家已经加大对民间体育非物质文化遗产的保护力度,在这个进程中,民间体育文化的发展已经唤醒了人们对其的热爱和追寻。本文以"山西挠羊赛"为视角,通过追溯其发展历史及目前的保护现状,然后分析民间体育非物质文化在法律保护上存在问题的原因,最后积极探寻解决其法律保护不足的对策建议。本文旨在唤起全民族的文化自觉性,希望对我国民间体育文化的发展起到抛砖引玉的作用。

First of all, intangible cultural heritage of folk sports has been unprece--dentedly im- pacted by rapid economic development, and faces with the awkward predicament. Luckily, the country has increased the protective strength, and intangible cultural heritage of folk sports a- wakens the people to love and pursue in the process of the protection and development of non-- material cultural heritage. The paper takes ＂Naoyang＂ wrestling match of Shanxi as cases, and reviews its history and actual plight. Then, the paper analyses the legal protection of intangible cultural heritage of folk sports on the cause of the problem, and actively explore the counter-- measure of intangible cultural heritage of folk sports on the legal protection. The purpose of this paper is to arouse the whole nation＇s cultural consciousness and provide a reference for the devel- opment of national folk sports in China.
